The State Department of the United States has published the visa bulletin for January 2025. The January Visa Bulletin issued by the State Department outlines the Final Action deadlines for the approval of a change of status application or the issuance of an immigrant visa. The green card applicants await the release of the US visa bulletin to take further action on their applications.
The latest Visa Bulletin outlines the number of immigrant visas available in January for setting Final Action Dates and Dates for Filing Applications, showing when applicants for immigrant visas should be informed to gather and submit the necessary documents to the National Visa Center.
Individuals seeking to file applications for adjustment of status with USCIS will have to use the “Final Action Dates” to determine when they can file such applications. When USCIS determines that there are more immigrant visas available for the fiscal year than there are known applicants for such visas, then applicants may instead use the “Dates for Filing Visa Applications”.
The fiscal year 2025 limit for family-sponsored preference immigrants is 226,000. The worldwide level for annual employment-based preference immigrants is at least 140,000. Section 202 prescribes that the per-country limit for preference immigrants is set at 7% of the total annual family-sponsored and employment-based preference limits, i.e., 25,620. The dependent area limit is set at 2%, or 7,320.
EB-1: India will remain on February 1, 2022, and China on November 8, 2022, while all other countries will remain current.
For employment-based preferences, significant movement was seen in the second preference (EB-2) category.
EB-2: India will advance two months, to October 1, 2012, while China will advance one month, to April 22, 2020. All other countries will move forward two weeks, to April 1, 2023.
EB-3 Professionals and Skilled Workers: India will advance three weeks to December 1, 2012, while China will advance two months until June 1, 2020. All other countries will move two weeks to December 1, 2022.
EB-5: For the EB-5 Unreserved categories, China will remain on July 15, 2016, and India on January 1, 2022. All other countries will stay current. The EB-5 set-aside categories (rural, high unemployment, and infrastructure) will also continue in effect.
In the family-sponsored categories, F1 moved from 22OCT15 to November 22, 2015, while F2B moved from 01MAY16 to 22MAY16 and F3 advanced from 15APR10 to July 1, 2010. Filing dates for F4 moved from 08MAR06 to 08APR06.
