US Issues Visa Warning: Continuous Monitoring, Risk of Deportation!

The U.S. government has reaffirmed that visa holders face continuous scrutiny, even after their visa is issued. Green Card holders, especially those frequently traveling abroad, are also under increased monitoring.

Travelling to the United States? Be aware: visa screening doesn’t end when you receive your visa. The U.S. Department of State recently confirmed a policy of continuous monitoring.

This means active visa holders are subject to ongoing checks to ensure compliance with U.S. laws and immigration regulations.

Ongoing Visa Monitoring and Its Implications
In a post on X (formerly Twitter) dated March 17, 2025, the State Department stated, “U.S. visa screening does not stop after a visa is issued. We continuously check visa holders to ensure they follow all U.S. laws and immigration rules – and we will revoke their visas and deport them if they don’t.”

This statement underscores a stricter approach to immigration enforcement, reflecting the broader push by conservative lawmakers to tighten policies due to economic and national security concerns.

Green Card Holders: No Longer a Guaranteed Stay?
Even lawful Permanent Residents (Green Card holders) are not exempt from heightened enforcement. Senator JD Vance recently emphasized in a Fox News interview that holding a Green Card does not guarantee an indefinite right to stay in the U.S.

This has sparked concerns among Indian Green Card holders, particularly elderly individuals who frequently travel between India and the U.S.

Targeting Elderly Travellers: CBP Scrutiny and Form I-407
Reports indicate that Customs and Border Protection (CBP) officers are specifically targeting these travellers upon their return to the U.S. The Times of India reports that officers are pressuring individuals to sign Form I-407, which effectively surrenders their permanent residency. Those who resist face threats of detention or deportation.

Why? Prolonged stays outside the U.S. can be interpreted as abandonment of residency. Immigration lawyers argue this enforcement is an overreach. However, many affected individuals, especially older travellers, feel compelled to comply.

The resulting uncertainty has left many feeling trapped, fearing that visiting their home country could jeopardize their status.

Impact on Indian Immigration to the US
India has consistently ranked among the largest sources of legal immigration to the U.S. However, the growing unease over visa and Green Card security is making some reconsider their future in the country.

With stricter regulations and increased scrutiny, visa holders must stay informed about compliance requirements to avoid legal complications.

Key Takeaways for Travellers

• Stay Informed: Regularly check for updates from the U.S. Department of State and CBP regarding immigration policies.
• Maintain Compliance: Ensure you adhere to all U.S. laws and immigration regulations.
• Document Your Stays: Keep detailed records of your time spent in and outside the U.S.
• Seek Legal Counsel: If you have concerns about your Green Card or visa status, consult with an experienced immigration attorney.
• Understand Form I-407: Before signing any documents at a port of entry, ensure you fully understand their implications.

As immigration policies tighten, visa holders and Green Card residents must remain vigilant, seek legal guidance if necessary, and ensure they adhere to all travel and residency requirements.
