H-1B Visa Update: New Form I-129 Mandatory for 2025 Petitions

USCIS has announced significant changes to the H-1B visa application process, impacting individuals seeking to work in the US in 2025. Notably, the agency will release an updated version of Form I-129, the primary form used for H-1B petitions, on January 17, 2025.

Key Updates to Form I-129

This new edition will replace the current 04/01/24 version, and there will be no grace period for transitioning to the updated form. Applications submitted using the older form after January 17, 2025, will be rejected. 

The revised Form I-129 applies to petitions for several nonimmigrant worker categories, including:

• H-1B, H-2A, H-2B, H-3: Temporary workers and trainees. 
• L-1: Intracompany transferees. 
• O-1, O-2: Individuals with extraordinary abilities and their assistants. 
• P categories: Artists, athletes, and entertainers. 
• Q-1, R-1: Cultural exchange visitors and religious workers. 

Petitioners can also use this form to request status extensions or changes for E-1, E-2, E-3, H-1B1, and TN classifications. 

What Does This Mean for H-1B Applicants? 
New Form I-129 Effective January 17, 2025: Starting this date, USCIS will only accept the revised version of Form I-129 (edition date: 01/17/25). 

No Grace Period: There will be no grace period for using the older version of the form. USCIS will reject any petitions submitted with the outdated 04/01/24 version on or after January 17, 2025, without review.
